My lawyer and case is in another state and my lawyer has not been answering any of my phone calls. I know that she has been ill in and out of the hospital. I live in another state and found out today that I have court tomorrow for motion to compel mediation and discovery. She is handling my case. I have no clue if she knows of the court date or not. What happens if she doesn’t show up?

It makes the judge VERY mad.
You need to contact the court and let them know that you have been trying to get in touch with your lawyer and request that until you do that a continuance be granted.
She should have scheduled a stand-in. You need to call and find out who that stand-in is. If she’s been ill then she should have someone else working your case. If she was not able to pull the information together for the discovery her stand-in could and probably would ask for another court date for her giving her time to get that information together. Call to be sure that’s happening. If by chance she didn’t show up and didn’t send a stand-in to court for her then you can report her to the Bar Association for not doing her duty and losing a decision for you. You can petition the court for another date or find yourself another attorney who will cancel out that first attorney and take your case to court for you.
