US Supreme Court Justice Stephen Breyer: A Presentation on International Law


The Blum Center for Developing Economies Presents: “International Law” A presentation by US Supreme Court Justice Stephen Breyer, followed by a conversation with Dean Christopher Edley, UC Berkeley School of Law. Stephen Breyer, born in San Francisco in 1938, is a graduate of Stanford, Oxford, and Harvard Law School. He taught law for many years at Harvard and has also worked as a Supreme Court law clerk, a Justice Department lawyer, an Assistant Watergate Special Prosecutor, and Chief Counsel of the Senate Judiciary Committee. In 1990 he was appointed an appellate court judge by President Carter. In 1994 he was appointed a Supreme Court Justice by President Clinton.     @combatvetlawstudent Not all nations share the idea of our documents that govern our land. So to persuade with aethiestic non constitutional principle ideas is to go against the oath of teh Constitution each judge takes.

    @combatvetlawstudent you also go away from the constutution and declaration of Independence which derives from the plain statement that humans have inalienable rights iven BY OUR CREATOR that cannot be refused, then to use reasoning outside such principles is to deny our original documents this land was created on!

    One problem w18:45ish quoting other countries in rulings is that our country originated on Christian principles as our documents show. Unalienable rights given by our CReator. English common law was based on likewise. THAT was what our forefathers created as law for our land. So when you start using reasoning derived from aetheistic nations who share not the idea of inaliendabelrights given by our country that our land is governened by in those documents, you curse our land.

    18:45 ish He says the citation in a ruling is NOT binding. Well it still is there for pursuasive effect. SO if in a case someone quotes or rules several citations or references to multiple foreign citations on an issue it HAS its effect. Kicking a door in while politely saying “can I come in?” is very similar to plain ol forcing in a decision. Consider accumulative affect as a form of binding.
