how should I choose between being a lawyer or being a research psychologist?
Monday, November 23rd, 2009Lawyers get to help people to get justice, but psychology sounds interesting. I like to analyze and write, and I hear that is a good quality for a lawyer to have. Isn’t it very stressful to be a lawyer though?
What type of lawyer spends the most amount of time at an office, not a courtroom?
Friday, November 20th, 2009On every TV show/movie that involved Lawyers, you see them in the courtroom arguing a case. Personally, I want to be a lawyer that spends more time at the office than public speaking/aruging at the courts. What type of lawyer spends the most time at the office instead of the courts?? Corporate Lawyers?? Intellectual Property Lawyers?? Some people want to argue their case in front of a jury or a judge, I do not. I would like to give people legal counsel but not have to really defend anyone by arguing their case.
What does a lawyer have to do to file a motion?
Thursday, November 19th, 2009The Correctional guards told my b/f he would be allowed to hold his newborn baby during a visit if the lawyer files a motion to do so. We asked the lawyer to do it a month ago, but he still hasnt done it. He acted like it was no problem. Does he have to go in front of the judge?
How do I deal with a lawyer that overcharged me in a court case and is now suing for payment?
Saturday, November 14th, 2009We hired a lawyer to represent us in a court case that an ex filed regarding modifcation of child support and visitation. Our lawyer overcharged us and when we questioned him, he removed him self as being on record as our lawyer with the courts and is now suing us for payment. We paid 75% of the bill, but have questions on some of the remaining charges.

Opertations:
1000Attorneys.com Lawyer Referral operates as a telephone service and online service. Potential clients call the intake number, where they are screened by an intake specialist. If a referral seems reasonable based on information given by the caller, the potential client is given the name and number of an attorney. We work on an underlying rotation system, by relevant panel in the geographic area requested by the client. Sometimes special circumstances require referral out of the rotation. LRS does not refer on the basis of ethnicity, gender or other characteristic unrelated to the legal area. We do, however, refer for non-English language ability if needed and we can.
The intake staff members are not in a position to give legal advice or to decide the merits of a claim. They do, however, try to refer matters that seem to have minimal damages or that do not hang together to the Neighborhood Legal Clinics for an initial consultation, or to Small Claims Court if the claimed damages fit that jurisdiction. They also try not to refer matters where the caller cannot articulate a legal matter.

My lawyer says I need to send a demand to a credit card company that’s reporting false information?
Thursday, November 12th, 2009He’s not my lawyer for this matter, but told me I need to send a demand to my credit card company for reporting false information to the credit bureaus. I have already disputed it without success. What is a demand letter? Where could I find a copy of one?
How to Decide Which Lawyer to Hire
Tuesday, November 10th, 2009
I have often been asked, how can an individual be expected to make a good decision whether an Attorney is competent for a clientâs needs; if this legal ruling called an attorney / client privilege detracts from a potential client being able to request references? Since each Attorney can claim client confidentiality, which precludes him or her from giving references; unless that Attorney has been sued for malpractice, how do you, the client know if the Attorney is simply slightly below or above average in his legal handling of his caseload?
Asking an Attorney for his litigation record of wins/losses can help to improve the odds of hiring a competent Attorney, yet every potential client should couple that action with a public search record of that Attorneyâs experience. With the world-wide web at our fingertips, it behooves every person seeking legal advice to not only question each Attorney you interview, but perform a public records search to ensure you have adequate information on an Attorney, before you put your legal issue into their hands.
These paradoxical questions are at the core of decision making skills that all Americans in-legal-need must be able to command. The need to ascertain the value of a lawyerâs ability to litigate is critical to your best bet to secure a winning verdict. When your financial future is on the line, how do you research an attorneyâs capabilities?
Outside of going online to a general search engine to research an Attorneyâs background in a specific state, which is scarce and fraught with potentially subjective and/or damaging comments from unhappy customers; what can you do to raise the stakes for finding a successful litigator? There are various solutions to finding a competent Attorney that has the experience in your legal issue and a history of litigating with a successful record.
These solutions range from asking targeted questions to an Attorney in a phone interview, prior to setting up an appointment; to performing targeted research by going to your Stateâs Legal Bar Association online and performing a malpractice search. Also there are a wide variety of search engines which provide host companies that keep records of Attorneys with good client references, as well as records of Attorneys with poor client complaints.
We suggest you use a combination of techniques to manage the process of hiring your next Attorney. Is it any less crucial than when you go to buy a home? Do you sign all the papers without asking questions about the legal ramifications of the documents from the Real Estate Agent? What if you had hired a less than competent Real Estate Agent and they had failed to review the documents to ensure that a fixed loan instead of a balloon payment structure was in the terms of your home purchase? Do you think you could claim malpractice against the Agent who failed to ensure your needs were met; or do you think a judge would ask you if you had protected your rights by careful review of the process?
A legal malpractice is just as hard to prove against an Attorney, unless a blatant claim of negligence on performance of legal services were established. As a plaintiff, you must prove a breach of duty of the Attorney resulted in an injury or loss to you. Nominal damages, by itself is insufficient to prove your cause of action. You would have to prove the underlying case had merit and there was no judicial error on the part of the court, plus you would have to establish a significant loss of your rights. It is far easier to perform a little extra leg work before hiring an Attorney, than losing a lawsuit with merit and going through the crisis of legal malpractice.
